How can I protect my spouse or partner ? 

Partnerships between people of different or the same sex are not recognised by Romanian law.

Through inclusion of the preference legacy clause in the marriage contract, it is possible to stipulate that the surviving spouse may take one or more joint assets that are held in indivision or in co-ownership, before the estate is divided up and without consideration. The preference legacy clause may be stipulated for the benefit of each of the spouses or just one of them (Art. 333 of the Civil Code). One must also take into account that this clause is also subject to reduction if the limits of the reserved portion of the estate are exceeded.
